By accessing or using the Serpent API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms apply to all users of the Service, including users who are registered account holders.
2. Description of Service
Serpent API provides a search engine results page (SERP) data retrieval service through an application programming interface (API). The Service allows users to programmatically access search results from various search engines.
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials and API keys
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
4. API Usage and Restrictions
4.1 Permitted Use
You may use the API for lawful purposes in accordance with these Terms and applicable laws.
4.2 Prohibited Use
You agree NOT to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Distribute malware, spam, or harmful content
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service or servers
- Resell or redistribute the Service without authorization

4.3 Rate Limits
We may impose rate limits on API requests. Exceeding rate limits may result in temporary or permanent suspension of access.
5. Billing and Payment
5.1 Pricing
Current pricing is displayed on our website. We reserve the right to modify pricing with 30 days notice.
5.2 Credits
The Service operates on a prepaid credit system. Credits are deducted based on API usage. Credits are non-refundable except as required by law. For detailed refund terms, please see our Cancellation & Refund Policy.
5.3 Payment Processing
Payments are processed through Dodo Payments (our payment processor). By making a payment, you agree to their terms of service in addition to these Terms.
6. Free Trial
New users receive 100 free API searches. Free searches expire after 12 months of account inactivity. Free searches are for evaluation purposes only.
7. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Serpent API and protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of any content you create using data obtained through the Service, subject to third-party rights.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to data practices described in our Privacy Policy.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted or error-free
- Results from the Service will be accurate or reliable
- Any errors in the Service will be corrected
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERPENT API SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Serpent API and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe:
- Violates these Terms
- Is harmful to other users or third parties
- Is harmful to our business interests
Upon termination, your right to use the Service will immediately cease. Unused credits are non-refundable upon termination for cause.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
15. Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules. The arbitration shall take place in India.
